Flexicurl Services

Flexicurl provides a platform for members to manage gym memberships, track workouts, check in to gyms, participate in challenges, and view progress. Flexicurl also provides a web management dashboard for gym owners to manage gym profiles, memberships, plans, attendance, payments, and member access.

Eligibility

You must be legally eligible to use Flexicurl in your country or region. If you use Flexicurl on behalf of a gym, business, or organization, you confirm that you are authorized to do so.

Accounts and Security

You are responsible for providing accurate account information and keeping your login credentials secure. You are responsible for activity that occurs under your account. You must notify us if you believe your account has been compromised.

Member Terms

Members may use the mobile app to manage memberships, subscriptions, passes, attendance, workouts, challenges, and progress. Flexicurl may reject, remove, or disqualify challenge attempts if we believe they violate rules, are fraudulent, unsafe, inaccurate, or otherwise inappropriate.

• Provide accurate account and membership information.
• Use gym access, passes, and check-ins honestly.
• Follow gym rules, safety instructions, and applicable laws.
• Use workout and challenge features responsibly.
• Upload only content they own or are authorized to upload.
• Do not submit false, misleading, unsafe, fraudulent, or manipulated challenge attempts.

Gym Owner Terms

Gym owners may use the web dashboard to create and manage gym profiles, plans, prices, memberships, attendance, access settings, payments, and member communications. Flexicurl may suspend or remove gym owner accounts, gym listings, payouts, or dashboard access if information is false, unlawful, misleading, unsafe, abusive, or violates these Terms.

• Provide accurate gym, pricing, facility, contact, and location information.
• Keep gym listings, plans, and availability up to date.
• Honor active memberships, subscriptions, and passes shown in Flexicurl unless there is a legitimate safety, fraud, payment, or policy reason to deny access.
• Use member information only for legitimate gym operations, membership management, attendance, access control, and support.
• Do not sell, misuse, scrape, export, disclose, or abuse member personal information.
• Comply with applicable laws, tax obligations, consumer protection rules, and payment provider requirements.
• Maintain safe and lawful gym operations.

Payments, Subscriptions, and Refunds

Flexicurl may support paid memberships, subscriptions, passes, commissions, and other payments. Payments may be processed by third-party payment providers. By making a payment, you agree to the price, billing terms, and payment method shown at checkout. Payment processing, settlement timing, refunds, chargebacks, and payout timing may depend on third-party payment providers. Refunds, cancellations, and membership changes are subject to the applicable plan terms, gym policy, payment provider rules, and applicable law.

Fitness and Health Disclaimer

Flexicurl provides fitness tracking, workout planning, gym membership, and challenge tools. Flexicurl does not provide medical advice. Exercise involves risk. You should consult a qualified medical professional before beginning or changing a fitness program, especially if you have a medical condition, injury, or health concern. You are responsible for exercising safely and using gyms, equipment, workouts, and challenges at your own risk.

User Content and Challenge Submissions

Users may upload profile images, gym images, workout notes, challenge videos, and other content. You retain ownership of your content, but you grant Flexicurl permission to use, store, process, display, and review that content as needed to operate the service. You must not upload content that is illegal, harmful, abusive, misleading, infringing, private without permission, or otherwise inappropriate.

Acceptable Use

• Do not use Flexicurl for unlawful, fraudulent, abusive, or harmful purposes.
• Do not attempt to bypass security, access controls, payment systems, or membership restrictions.
• Do not create fake accounts or impersonate others.
• Do not interfere with the operation of Flexicurl.
• Do not reverse engineer, scrape, copy, or misuse the platform.
• Do not upload malicious code or harmful content.
• Do not misuse personal data belonging to members, gym owners, or other users.

Suspension and Termination

We may suspend, restrict, or terminate access to Flexicurl if we believe a user has violated these Terms, created risk, misused the platform, failed to pay required fees, provided false information, or violated applicable law. Users may stop using Flexicurl at any time and may request account deletion by contacting support@flexicurl.fit.

Third-Party Services

Flexicurl may integrate with third-party services such as payment providers, authentication providers, cloud providers, email providers, OTP providers, analytics tools, and app stores. These services may have their own terms and privacy policies. We are not responsible for third-party services except where required by law.

Availability and Changes

We may modify, suspend, or discontinue parts of Flexicurl at any time. We may also update features, pricing, plans, or platform rules. We will try to provide notice when changes materially affect users.

Limitation of Liability

To the maximum extent permitted by law, Flexicurl is provided on an "as is" and "as available" basis. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, business, fitness progress, gym access, or reputation. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnity

You agree to indemnify and hold Flexicurl harmless from claims, damages, losses, liabilities, and expenses arising from your misuse of Flexicurl, violation of these Terms, violation of law, or infringement of third-party rights.

Governing Law

These Terms are governed by the laws applicable to Flexicurl Inc. in its place of establishment, unless applicable consumer protection law requires otherwise.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on https://flexicurl.fit with a revised effective date. Continued use of Flexicurl after changes means you accept the updated Terms.
